Terms and Conditions of Use

It shouldn’t be necessary to have a page like this and I truly hope it's never needed. Whilst I could probably sum up the blatantly obvious in a few lines, such as:

I could be wrong... I'm human... don't rely on what I say without verifying it elsewhere

Just because I do something, it doesn't mean you should... what works for me might not work for you.

Take good care of yourself and others, wear all appropriate safety gear, take all relevant precautions, educate yourself and don't use or misuse anything you glean from me in a way that could hurt you or others.

If you hurt yourself or others, if you damage your property or that of another, don't blame me. I'm not responsible for anything you do. My material is given freely for educational / entertainment purposes only. You have to take responsibility for your own actions.

If you’re at all unsure, it’s probably best not to copy or emulate anything you may see or read about me doing… better safe than sorry.

Please don't steal my stuff (don't copy it, sell it, claim it as yours, etc). If you want something of mine, ask. I might say yes.

And if you can't rely on yourself to follow the above, it's best you don't read or watch my stuff!

... I suppose it's appropriate to try and make things a little more legally astute. So please read these Terms of Use carefully before browsing this website or viewing my videos. And if you can't understand what follows, read through the above again... I hope they pretty much say the same thing. However, do look out for these little stylised snippets (like those above) that occur throughout this page. They're my margin notes, if you like, intended to try and make things clearer. They are NOT meant to detract from the legal sense of what follows (and if they do - ignore them) but hopefully make clearer what I'm trying to convey. If it doubt, drop me a line.

1 Acceptance Of Terms

Your access to my Videos and this Website, hereafter collectively known as Material, is considered to be subject exclusively to these Terms and Conditions. You will not use the information so gathered for any purpose that is unlawful or prohibited by these Terms and Conditions. By using my Material you are fully accepting the terms, conditions and disclaimers. If you do not accept these Terms and Conditions then please stop using / viewing my Material.

2 Advice

The contents of the my Material do not constitute advice and should not be relied upon in making or refraining from making, any decision.

Whilst as accurate as I can manage, any information provided is only in the form of my opinion. Any facts, figures, statements, quotes, advice, etc, should be independently verified by yourself for accuracy or completeness. Similarly any recommendations made are based purely on my personal experience and preference. I offer no guarantee as to the accuracy or reliability of any of the information presented. In short, it's your choice - don't blame me if it's wrong.

3 Changes To Material

I reserve the right to:

3.1 change or remove (temporarily or permanently) the Material or any part of it without notice and you confirm that I shall not be liable to you for any such change or removal; and

3.2 change these Terms and Conditions at any time, and your continued use of the Material following any changes shall be deemed to be your acceptance of such change.

4 Links To Third Party Material

My Material may include links to third party Material that are controlled and maintained by others. Any such link is not an endorsement and you acknowledge and agree that I am not responsible for the content or availability of any such Material.

5 Copyright

5.1 All copyright, trade marks and all other intellectual property rights in my Material (including without limitation the Website design, text, graphics, logos, and all software and source codes connected with the Material) are owned by or licensed to myself as permitted by law.

5.2 In accessing the Material you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Material specifically set aside for that purpose for personal, non-commercial home use.

6 Disclaimers And Limitation Of Liability

6.1 The Material is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

6.2 To the extent permitted by law, I will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits, personal / third party injury or death) arising out of or in connection with the use or misuse of the Material.

6.3 I make no warranty that the functionality of the Material will be uninterrupted or error free, that defects will be corrected or that the Material or the servers that makes it available are free of viruses or anything else which may be harmful or destructive.

7 Indemnity

You agree to indemnify and hold me from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against me arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of my Material.

8 Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

9 Cookies

The Material may at times use cookies indirectly by making use of:

9.1 Google Ad-sense: These are the adverts that appear within website pages and videos. It's my understanding that Google uses cookies to help display relevant ads and the small revenue this generates helps in part cover my costs. Further, I understand there's personal ads and non-personal ads. With personal ads, you tell Google the kind things that interest you (e.g. Gardening, Pet Care, Construction, etc) and Google tries to display ads that you'll find interesting. With non-personal ads, you'll still see adverts but on random topics. Google has a very helpful video on Cookies in their own policies section that’s quite informative… here. If you do not wish to see Ads whilst browsing this website, please see point number 3 below.

9.2 Google Analytics (opt out of Google Analytics here) which tracks website traffic producing detailed statistics about site activity. Google Analytics provides me with useful information like how many people visit my material, what they looked at, etc, which helps me to provide the sort of things my viewers and readers want to see. It certainly does NOT provide any sensitive (personal) data about visitors that I'm aware of - and certainly I collect none.

9.3 Turning Off Ads: Purely as an optional extra I have, ironically, made use of cookies to disable viewing ads on this website. Simply visit this page www.vegoilguy.co.uk/no-ads and a cookie will be activated to turn off the ads and remember not to show them again for 24 hours. (How does this work? Each page as it opens looks to see if this cookie exists. If it doesn't, ads are shown, if it does, ads aren't shown. After 24 hours the cookie self deletes. Absolutely no personal data is required, not even your IP address.)

10 Donations

Donations are not compulsory but are gratefully received. Donations are deemed to funds or assets freely given, with no consequent obligation to the recipient to provide goods or services to the benefit of the donor or other parties. Once received and cleared, donations are non refundable.

If you're kind enough to give me a donation, it doesn't mean I'm obligated to help you - it doesn't mean I'm working for you. A donation is simply a kind offering freely given without expecting anything in return. And please don't ask for the money back later on because I will have spent it. So if you're not sure, then don't donate, but if you do - God bless you!

11 Supporters Donations

11.1 A Supporter is someone who agrees to donate a set amount on an on-going monthly basis. Donations are deemed to be funds or assets freely given, with no consequent obligation to the Recipient to provide goods or services to the benefit of the donator or other parties.

11.2 Supporters payments are made strictly through PayPal and payment schedules are therefore controlled through that media.

11.3 Supporters may amend or cancel their donation through PayPal at any time.

11.4 Whilst under no obligation, the Recipient chooses to thank Supporters with a number of Tiers on an ex gratia basis, each relating to a specific level of regular support. Within these Tiers are various items accessible to Supporters that may include, though not specifically, articles of interest, images, tutorials, files, etc, updated on an on-going basis, each intended to provide a level of entertainment. These Tiers are described more fully on the VOG Library landing page and are not fully inclusive and may be subject to change without notice. Supporters may access Tiers according to their level of Support donations, further to donations being received & cleared, and subject to any time restrictions that may apply. Cancelling Support donations will result in immediate loss of access to Tiers.

11.5 The Tiers and subsequent material are contained online within the VOG Library and are accessible by Login details, controlled by the Recipient and in accordance with relevant Terms and Conditions herein described.

11.6 Whilst the Tiers are provided ex gratia, all copyright, trade marks and all other intellectual property rights are owned by or licensed to the Recipient. In accessing the Tiers you agree that you will access the content solely for your personal, non-commercial use. None of the content may be reproduced, transmitted, sold or distributed without the prior written consent of the copyright holder.

11.7 Once received and cleared, supported donations are non-refundable.

11.8 Regardless of Support donations received, the Recipient reserves the right to allow or disallow access to any party.

So I'm the Recipient. The Supporter / Donator is the one generously giving me money (let's say it's you). It's important to realise this is simply a regular Donation agreement - regular Support doesn't mean I work for you and I'm not obligated to give you anything... you're giving freely, expecting nothing in return. You are in complete control and I don't have access to your Payment details. But as a 'thank you' I'll try to maintain a Library of fun and interesting stuff for folks to peruse. I'll update this as often as I can and ultimately I say who can, and who can't access it.

12 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

13 Privacy

I respect the privacy of every individual and strive to adhere to the General Data Protection Regulation 2016/679. I do not actively or convertly collect any information about you (other than indirectly via third parties, namely Google Analytics and Good Adsense - see 9.1 & 9.2 Cookies above). Any information I may hold will likely have been given freely by you through Social Media platforms and emails. However, I collate none of it and treat all communications as confidential. Email correspondence is stored locally and in the cloud using JustCloud backup services (see www.justcloud.com for their security, encryption and privacy controls). The Search Bar on my websites stores no information and compares your search enquiry against a database of keywords that I have recorded on the website. Any donations received will be processed through PayPal using their encryption processes and I will not receive your banking details, etc. I use Heart Internet to host my websites. The contact forms operate through Formspree (see their Privacy Policy). You can check the information that I hold about you by emailing me and if you have any specific concerns regarding your privacy in relation to my websites and / or any correspondence we may have shared, please contact me directly to discuss this and I will do my best to help.
